FRAC Wins Summary Judgment in Texas Federal Court in NFA "$0 Tax” Constitutional Challenge

Industry Members, Allies, and Supporters,
I am proud to share with you that FRAC has won its Summary Judgment motion before the United States District Court for the Northern District of Texas in its $0 NFA Tax case, with the Court holding that the NFA’s registration requirement for $0 tax rate firearms is unconstitutional under the Taxing & Spending Clause of the U.S. Constitution. While the presiding Judge issued a 7-day stay of his Order, effectively pausing its implementation, to give the government defendants time to appeal—and most likely this will be litigated on appeal—this victory is a critical waypoint in the effort to bring down the archaic body of law known as the National Firearms Act.
FRAC stands with the industry and consumers alike in demanding full accountability of firearms technology regulations—with the NFA representing one of the most significant sources of such overreach. It is time for the NFA to be reconsidered and retired as outdated law.
