Press Release: FRAC Applauds Rep. Dan Crenshaw (R-TX-2) and Rep. Henry Cuellar (D-TX-28) for Introducing The ATF Accountability Act of 2021 To Create a Transparent Appeals Process within the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF)

Washington, D.C. - The Firearms Regulatory Accountability Coalition, Inc., (FRAC) applauds Rep. Dan Crenshaw (R-TX-2) and Rep. Henry Cuellar (D-TX-28) for working with FRAC to introduce The ATF Accountability Act of 2021, much needed bipartisan legislation that creates a transparent appeals and review process against arbitrary and capricious rulings and determinations by ATF—particularly, the Firearms and Ammunition Technology Division (FATD).


FRAC member companies strongly support The ATF Accountability Act of 2021 as it promotes sound regulatory procedures for an industry struggling to keep pace with an agency that has been issuing private legal interpretations in an ad hoc and inconsistent manner for years. The proposed procedures will help alleviate regulatory uncertainty and allow licensees to ensure compliance with federal law through a more fair and transparent process within the ATF.


In 2020, FRAC was successful in alerting and mobilizing the industry to pressure the ATF to remove harmful and reckless guidance on the classification of pistol braces that would have cost the firearms industry over $1 billion dollars in lost revenue and thousands of American manufacturing jobs. We are sincerely appreciative of Rep. Crenshaw’s and Rep. Cuellar’s resolve in introducing this legislation, as it will give small businesses an opportunity to immediately address ATF rulings that are contrary to law or arbitrarily inconsistent with prior rulings, without having to spend hundreds of thousands of dollars in federal lawsuits.


FRAC’s mission is to advocate for greater transparency in Washington through policies that promote a fair regulatory environment for American small businesses. FRAC will seek to work with Congress and the Administration to develop sound policy that fosters innovation throughout the firearms industry. But FRAC will not shy away from standing up to the federal government when companies are on the receiving end of unwritten or arbitrary actions that undermine a predictable business environment.
